We know that most of us and for sure all of our beaked friends do not like to go through boring legal bla bla bla that makes everyone sleepy. It’s a legal obligation that we set and publish the rules of engagement and specific conditions governing the activities of the website visitors.
You will see that the language used below might be “bland” and sometimes even “harsh” - this is lawyers jargon used to lay the groundwork for our interruption with you. Please take a moment to forage through these Terms and Conditions.

This website is operated by Posseder Limited. Throughout the site, the terms “we”, “us” and “our” refer to Posseder Limited. Posseder Limited offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. We must receive payment of the whole of the price for the goods that you order before your order can be accepted.
You guarantee that all details you provide to us for the purpose of ordering or purchasing products and Services are correct, that the payment debit or credit you are using is your own or you have full authorisation to use the card, and that there are sufficient funds to cover the products and Services ordered.
We do our best to ensure that all prices shown on our website are accurate and up to date. Despite our best efforts, errors may occur. If we discover an error, we will contact you as soon as possible to confirm whether you want to purchase our products and Services or cancel the order. If we are unsuccessful in contacting you, we will treat the order as cancelled. If we accept and process your order, either partially or in full, with an evident and unmistakable pricing error that could have reasonably been identified by you as a mispricing, we may cancel the contract, ask you to return any product already provided to you, and refund sums you have paid.
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of any product or Service.

As we work with natural materials, it is expected that products may not be identical due to without limitation variations in colours, sizes, composition, harvesting season, manufacturing processes and other specifications. Images shown at the store are for illustrative purposes only, and products received may not match precisely what is illustrated on our website.
Handmade products may have variations in size, and it is expected that items may vary individually both from the same batch and from a previous order.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We strive to provide you with high-quality products and Services. You acknowledge that there may be instances where the quality of products, services, or information obtained by you may not fully align with your expectations.
While we exert utmost diligence to ensure the safety of all products and Services we supply, it is imperative that you thoroughly check and inspect all received items and notify us immediately in writing if any safety concerns arise. You must not use any products and Services if you suspect the safety may be compromised until after you receive written instructions from us.
We advise full supervision when using all our products at all times, especially items containing small beads, pellets, fibres, ropes, laces and analogous materials.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit or debit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address and/or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by unauthorised dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, so that we can complete your transactions and contact you as needed in case of a problem with your order.
SECTION 7 - YOUR RIGHT TO CANCEL THE CONTRACT
The nature of our products makes it impractical to accept returns because we cannot guarantee the sterilisation and safety of physical items if they are returned. If you change your mind about the product after you receive it, the contract cannot be cancelled for hygiene and safety reasons.
If by the time you change your mind we have already shipped the items and our courier partners can still cancel the delivery and return the items back to us, we will refund the full product amount paid minus the shipping cost and credit card or payment platform processing fees. If the shipping was provided for free because your purchase was over the free shipping threshold, the incurred cost of shipping will not be refunded and will be deducted from the refund amount.
If by the time you change your mind we haven’t dispatched the items, we will refund the full product amount paid minus credit card or payment platform processing fees.

If you want to end the contract because of one of the reasons set out below, the contract will end immediately, and we will refund you in full for any products and Services which you have paid for but which have not been supplied to you. The reasons are:
(a) we have told you about an upcoming change to the product or these terms which you do not agree to;
(b) we have told you about an error in the price or description of the product you have ordered, and you do not wish to proceed;
(c) we have told you that supply of the products may be significantly delayed because of events outside our control, and you do not wish to proceed or wait;
(d) we have suspended supply of the products for technical reasons, or notify you we are going to suspend them for technical reasons for a prolonged period of time, and you do not wish to wait.
SECTION 8 - OUR RIGHT TO CANCEL THE CONTRACT
We reserve the right to cancel the contract because of one of the reasons set out below:
(a) ordered products and Services were listed at an incorrect price due to a mistake on our website (not limiting to a typographical error, wrong information from services that provide currency conversion on our website, wrong information received from our suppliers, wrong information received from our delivery and courier partners);
(b) we cannot fulfil your order either partially or in full due to insufficient stock, or we experience unreasonable delays to restock the required items;
(c) our courier partners do not deliver to your area, or delivery to your address became unattainable for our courier partners because of the reasons beyond our control (please refer to the “Force majeure” section below);
(d) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products, for example, the address for delivery;
(e) you do not, within a reasonable time, allow us to deliver the products to you (for example, you fail to respond to calling cards and notifications from our courier partners);
(f) we deem you being an unreasonable person to deal with.
We will notify you if we cancel the contract by getting in touch with you via any legally available method, such as your email address, telephone number, postal address or a social media profile you have provided during checkout. We will refund any money you have paid to us for products and Services we have not provided, minus any reasonable fees incurred by us if you break the contract according to the reasons set above. We will not be obliged to offer any additional compensation for consequential loss, inconvenience or disappointment suffered.
SECTION 9 - WARRANTIES FOR PRODUCTS AND SERVICES
By placing your order for the products and Services you fully understand and agree that the items are designed to become worn, torn and damaged once your birds start playing with them, unless explicitly specified in the product description.
Our products are considered to be consumables and have a limited lifespan whether or not being actively used, unless explicitly specified in the product description. In particular, products made of natural materials and not treated by specialised chemical substances may, without limitation, naturally fade out, go through stages of organic decomposition, and start to crumble.
You agree to indemnify us from any claim and demand to refund and/or reimburse, partially or in full, for any damages to the purchased products starting from the moment they have been used for the first time.
If you suspect the products and Services arrived damaged, or the received products are not what you ordered, we shall have no liability to you unless you notify us by getting in touch via the website chat, or the contact page at www.cozybeaks.com/contact-us or writing to us at support@cozybeaks.com within 7 calendar days of the delivery of the items in question.
If we establish that the products arrived defective or we shipped you incorrect items, we will (a) attempt to repair or replace the defective or incorrectly dispatched items; or (b) refund you the amount paid for the defective items.
If you choose to relocate the products from the original point of delivery, and a collection or replacement becomes necessary, we will only provide this service to the original delivery address. We may, at our sole discretion, offer to collect products from or deliver replacement products to another location you relocated to, and you may be asked to pay an additional charge.
SECTION 10 - DELIVERIES
We will deliver products and Services to address your provided during checkout once your order has been accepted, providing the delivery address is reachable by our courier partners.
The delivery time frame displayed during the checkout is approximated by our courier partners based on the delivery address you provide, for example using a postcode. In certain situations the courier partners may contact us for further information or clarification, if:
(a) address provided by you is incorrect or doesn’t match the courier’s database of known addresses;
(b) address provided by you is incomplete or partially complete, for example you missed the flat number in a multi-apartment building;
(c) address provided by you cannot be reached by the courier's existing delivery network, for example if the delivery address is in a remote location.
We will attempt to contact you to obtain missing information, resolve errors and find alternative solutions should there be a problem with the delivery address. We reserve the right to cancel the order if you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products, for example, the corrected delivery address.
In case that our courier partners have to contact us to resolve issues with the delivery address, we reserve the right to extend the delivery time frame indicated during checkout.
We cannot guarantee that our courier partners will spot errors or misspelling in the delivery address you provided during checkout before the delivery is attempted. You agree to cover any additional fees that our courier partners may ask you to pay to re-deliver your order if the original delivery address you provided was incorrect or partially correct.
If you are not around when the delivery is attempted, our courier partners will leave a calling card or notify you of the delivery attempt and tell you how to rearrange delivery or collection of the products. You acknowledge and agree that failure to respond to calling cards and notifications from our courier partners and/or us may result in the goods being returned to us. You agree to be responsible and liable for any delivery charges incurred to ourselves to return undelivered products, as well as the restocking fees and packaging fees.
We are not liable for the delivery delays outside of our control, such as without limitations bad weather, courier delays, strikes or industrial actions, or force majeure (please refer to the “Force majeure” section below).
You acknowledge and agree to observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
You acknowledge and agree that any customs, duties or additional charges which apply to your order (if your order is delivered outside of the UK or EU, for instance) will be your responsibility and are not included in the delivery costs, unless explicitly mentioned in the product description or the checkout section.
SECTION 11 - RETURNS

For security reasons refunds can only be made to the same card or method which was used for purchase. If it is not possible for us to provide a refund via the method you used for payment, we will provide a store coupon to the equivalent value.
Our returns policy does not affect any statutory rights that you have.

SECTION 12 - GIFT CARDS
Your gift card will be issued in the form of a digital code, delivered to the email address specified during the check out.
Gift cards purchased at our web store are valid for 12 months from the date of purchase, and may only be redeemed in our web store.
Gift cards cannot be exchanged for cash, resold or transferred, and you cannot purchase a gift card using another gift card as payment.
We accept no responsibility for the gift cards which are lost, stolen or used without your permission. We will not replace gift cards which are lost, stolen or used without your permission.
Purchased gift cards cannot be refunded or cancelled.
